Park Pals Terms & Conditions
Welcome to Park Pals. By booking or using our services, you (“Client,” “Parent,” or “Guardian”) agree to the following Terms & Conditions. Please read carefully, as they outline the responsibilities, limitations, and agreements between you and Park Pals, LLC (“Company,” “we,” or “our”).
1. Scope of Services
- Park Pals provides childcare and nanny services within theme parks, attractions, and approved off-site locations globally.
- Services are limited to childcare, supervision, and family assistance. Nannies do not provide medical care beyond basic first aid and CPR.
- Park Pals reserves the right to decline services if conditions are unsafe, unlawful, or beyond the reasonable scope of childcare.
Drug-Free Workplace Policy - Park Pals is a 100% drug-free company committed to the safety and well-being of the children in our care. All employees and contractors undergo pre-employment drug testing before being hired, in accordance with applicable local laws. Additionally, Park Pals reserves the right to conduct drug testing in the event of an accident or if there is reasonable suspicion of substance use, where legally permitted. Failure to comply with drug testing requirements or a positive test result will result in immediate termination of services.
Special Needs Accommodations
- Park Pals welcomes families with children who have special needs. However, to ensure that the complex and individualized needs of children with special needs are met at all times, our Park Pals will not remain with the family for the full duration of trips involving children with special needs. This allows parents and guardians to maintain the continuity of care and specialized attention that these children require. Families are encouraged to discuss their specific needs during the booking process.
Service Availability
- Services are subject to availability and may vary by location. Park Pals operates in multiple countries and jurisdictions, and services must comply with all applicable local laws and regulations.
2. Booking & Payment
- Bookings must be made through the Park Pals app/website.
- Families may choose to pay in full or pay a deposit at checkout.
- Hourly rates, minimum booking requirements, and service fees are listed on our website/app and are subject to change.
Currency & Payment Methods
- All prices are displayed in the currency applicable to your booking location. Payment may be processed in your local currency or US Dollars (USD), depending on your location. Currency conversion fees, if applicable, are the responsibility of the Client.
- We accept major credit cards, debit cards, and other payment methods as displayed at checkout. Payment processing is handled securely through third-party payment processors.
- Additional costs (e.g., park admission, meals, activities, or merchandise) are the sole responsibility of the Client.
Holiday Pricing Policy - An additional $15/hour (or equivalent in local currency) will apply to bookings on the following holidays: Easter, Memorial Day, Independence Day, Labor Day, Thanksgiving, Christmas Day, and New Year's Eve. Additional local or national holidays may also incur holiday pricing depending on the service location.
Taxes & Fees
- Prices exclude applicable taxes, including but not limited to VAT (Value Added Tax), GST (Goods and Services Tax), or other local taxes, which will be added at checkout where required by law.
3. Cancellations & Refunds
Deposit & Payment Policy
- At checkout, families are responsible for payment in full.
Cancellation Policy
- 30 days or more before service: 100% refund.
- 8–29 days before service: 50% refund.
- Less than or equal to 7 days before service: No refund.
Consumer Rights
- For clients in the European Union, the United Kingdom, and other jurisdictions with mandatory consumer protection laws, you may have additional cancellation rights under local law. Where applicable law provides greater rights than stated in this policy, those legal rights shall prevail.
Travel Insurance Option
- Families may purchase Park Pals Travel Protection at checkout.
- With travel insurance:
- Cancellations made up to 7 days before service are eligible for a 100% refund.
○ Cancellations made less than 7 days before serviceare non-refundable except in the event of a documented medical emergency.
Medical Exception
- Cancellations made up to 7 days before service are eligible for a 100% refund.
- If cancellation occurs due to a verifiable medical reason, families may request a refund.
- Documentation (e.g., physician’s note) must be provided.
- Park Pals reserves the right to approve or deny medical refund requests at its sole discretion.
Refund Processing - Approved refunds will be processed within 14 business days (or as required by local law) to the original payment method.
Purpose of Policy
- This policy exists to protect the time, preparation, and commitment our nannies dedicate to your family. Once a nanny has reserved your trip dates, they set aside personal and professional obligations to make your vacation as special as possible.
4. Health, Safety & Responsibilities
- Parents/Guardians must provide accurate information about the child(ren), including allergies, medical needs, and behavioral concerns.
- Children must meet the theme park's health and safety requirements for participation in rides and attractions.
- Park Pals nannies are trained in CPR and first aid (or equivalent local certifications) but are not responsible for providing professional medical care.
- In the event of a medical emergency, Park Pals will contact emergency services and the Parent/Guardian immediately.
Sickness Policy
- If your child is contagious, has a fever, or is continuously vomiting, the booking will need to be canceled.
- If a child develops a contagion or fever during a booking, the Park Pal has the right to cancel services and request that the Parent/Guardian return immediately.
- No refunds will be provided for cancellations due to child illness, as your Park Pal has reserved this time exclusively for your family.
- If your Park Pal is ill, a replacement will be sent whenever possible. In the highly unlikely event that a replacement cannot be found, you will receive a full refund.
Safe Sleep Policy
- All Park Pals follow American Academy of Pediatrics (AAP) safe sleep guidelines for children 12 months and younger:
- Babies are placed on their backs in a crib or pack-and-play.
- Firm mattress with fitted sheet only.
- No blankets, pillows, or toys (sleep sacks are permitted).
- Room temperature between 68–72°F.
- We will not place a child to sleep without a safe sleep environment. If a safe space is not available, contact or supervised nap holding may be permitted at parent request.
5. Parent/Guardian Obligations
- The Parent/Guardian must remain reachable by phone/text or through the app throughout the booking.
- Proper supplies must be provided, including food, diapers, clothing, medications, strollers, or other necessities.
- Parents/Guardians are responsible for granting permission for rides, attractions, and activities.
Parking & Transportation Reimbursement Policy
- If paid parking or transportation costs are required for your hotel or location, your Park Pal will upload the receipt through the Park Pals app.
- A reimbursement request will then be issued to the Parent/Guardian for payment in the applicable local currency.
6. Code of Conduct
- Park Pals maintains a zero-tolerance policy for abuse, harassment, discrimination, or unsafe conduct toward staff or children.
- Nannies may end services immediately if a child's behavior creates an unsafe situation or if parents fail to disclose critical information.
7. Liability & Insurance
- Park Pals maintains liability insurance appropriate for childcare services in the jurisdictions where we operate.
- Park Pals is not liable for injuries, illnesses, accidents, or property loss beyond what is covered by our insurance policy and as permitted by applicable law.
- Parents/Guardians assume all risks associated with theme park visits and activities.
Limitation of Liability
- To the maximum extent permitted by law, Park Pals' total liability for any claim arising from our services shall not exceed the total amount paid by the Client for the specific booking in question.
- Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
8. Independent Contractors
- All Park Pals nannies are independent contractors, not employees.
- Park Pals conducts background checks, reference verification, and CPR certification requirements (or equivalent local certifications) in accordance with local laws and regulations.
- Background check standards may vary by jurisdiction based on local legal requirements and available databases.
9. Technology, GPS Tracking & Tipping
- Parents may have access to GPS tracking and communication through the Park Pals app, subject to local privacy laws and with appropriate consent.
- Park Pals may use photos or updates for communication purposes during the service, but will not share or publish without explicit parental consent.
Tipping Policy
- Tips are not required, but are always appreciated. Families may provide cash tips directly or use a nanny's preferred digital payment method (e.g., Venmo, CashApp, PayPal, or local equivalent). Tipping customs may vary by country and region.
10. Confidentiality & Privacy
- Park Pals is committed to protecting your privacy and personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) for EU residents, the UK GDPR, the California Consumer Privacy Act (CCPA), and other applicable privacy laws.
Data Collection & Use - We collect and process personal information including but not limited to: parent/guardian contact information, child information (name, age, health needs, allergies), payment information, and location data.
- This information is used solely to provide our services, ensure child safety, facilitate communication, process payments, and comply with legal obligations.
Legal Basis for Processing (GDPR)
- For EU/UK residents, we process your data based on:
- Contract performance (to provide our services)
- Legitimate interests (child safety, service improvement)
- Legal obligations (background checks, tax compliance)
- Consent (for optional features like photos, marketing communications)
Data Retention
- We retain personal data only as long as necessary to provide services, comply with legal obligations, resolve disputes, and enforce our agreements. Specific retention periods vary by data type and legal requirements.
Your Rights
- Depending on your location, you may have rights including:
- Access to your personal data
- Correction of inaccurate data
- Deletion of your data (right to be forgotten)
- Restriction of processing
- Data portability
- Objection to processing
- Withdrawal of consent

International Data Transfers
- If you are located outside the United States, your personal data may be transferred to and processed in the United States or other countries where our service providers operate. We ensure appropriate safeguards are in place for such transfers in compliance with applicable law.

- Legal authorities, when required by law
- Emergency services in case of child safety emergencies

- While we collect information about children to provide our services, our services are booked by adults. We do not knowingly collect personal information directly from children under 13 (or applicable age in your jurisdiction) without parental consent.

11. Governing Law
- These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions, except where consumer protection laws of your jurisdiction mandate otherwise.
Jurisdiction
- For clients located in the United States, any disputes shall be resolved in the courts of [County, Florida] or [County, California].
- For clients located in the European Union or the United Kingdom, you may bring legal proceedings in the courts of your country of residence, and nothing in these Terms affects your statutory rights as a consumer.
- For clients in other jurisdictions, disputes shall be resolved in accordance with local mandatory consumer protection laws, or where such laws do not apply, in the courts of Florida, United States.
Alternative Dispute Resolution
- For EU residents, you may also use the European Commission's Online Dispute Resolution platform athttps://ec.europa.eu/consumers/odr.
- We are committed to resolving disputes amicably and encourage you to contact us directly before pursuing formal legal action.
Class Action Waiver
- Where permitted by law, you agree to resolve disputes on an individual basis and waive the right to participate in class action lawsuits. This waiver does not apply where prohibited by law.
12. Limitation Period for Claims
- Any claims arising from our services must be brought within one (1) year of the date the cause of action arose, except where local law provides a longer limitation period, in which case the longer period shall apply.
13. Language & Translation
- These Terms are originally drafted in English. If translated into other languages for your convenience, the English version shall prevail in case of any conflict or discrepancy, except where local law requires otherwise.
14. Severability
- If any provision of these Terms is found to be invalid or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
15. Changes to Terms
- Park Pals reserves the right to modify these Terms & Conditions at any time. Changes will be effective upon posting to our website/app. Continued use of our services after changes constitutes acceptance of the modified Terms. For material changes, we will provide notice via email or app notification where required by law.

17. Agreement & Acceptance
- By booking Park Pals services, you acknowledge that you have read, understood, and agree to these Terms & Conditions. You confirm that you have the legal authority to enter into this agreement on behalf of yourself and any children for whom you are booking services.
For EU/UK Consumers:
- You acknowledge your right to cancel within 14 days of booking (cooling-off period), unless you have expressly requested that services begin during this period and acknowledge that you will lose your right to cancel once services have been fully performed.
